Social Security Disability Appeals

Many disability claims are denied the first time. You generally have 60 days after receiving a denial notice to request the next level of review, and the record built during reconsideration and the hearing usually decides the case. Hargrove Law represents claimants anywhere in the United States: Social Security permits eligible attorneys in good standing who register with the agency to represent claimants nationwide, and hearings can be held by phone or online video.

The stages of an appeal

The review process can include three administrative stages (reconsideration, a hearing before an administrative law judge, and Appeals Council review), followed by judicial review in federal court. Hargrove Law handles the administrative stages.

Watch the 60-day deadline

The appeal period generally runs 60 days from when you receive the notice, and Social Security assumes you received it five days after the date printed on it. Keep the envelope and write down the day it arrived.

What to bring to the first conversation

  • Your most recent decision or denial notice
  • The date the notice arrived
  • Earlier applications, appeals, and decisions
  • A list of treating doctors and recent jobs

Keep these for your own reference until you receive instructions about sharing documents.
